Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Whichi ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

Whichi is proprietary software. You are granted a limited, non-exclusive, non-transferable license to use the Software for personal or commercial purposes, subject to these Terms.

Whichi is built upon open-source components:

• Dyad - Licensed under Apache License 2.0
• Spec Kit - Licensed under MIT License

While these underlying open-source components retain their respective licenses, the Whichi application as a whole, including its branding, proprietary features, and integrations, is not open source.

3. Trial and Licensing

7-Day Free Trial: New users receive a 7-day free trial to evaluate Whichi. No credit card required. The trial automatically expires after 7 days.

BYOK (Bring Your Own Key): After trial expiration, you can continue using Whichi by providing your own API keys from supported AI providers (OpenAI, Anthropic, Google, OpenRouter, Ollama, etc.). This option is free but requires your own provider accounts.

Lifetime Deals (LTD): Whichi offers one-time license tiers such as Solo Dev, Pro Builder, Team, and Enterprise. LTD licenses specify seat limits (number of devices) and which providers are allowed per tier. No AI credits are sold by Whichi.

4. User Responsibilities

You agree to:

• Use the Software in compliance with all applicable laws and regulations
• Not use the Software for illegal, harmful, or malicious purposes
• Secure your own API keys and credentials (BYOK model)
• Respect third-party AI provider terms when using their APIs
• Not attempt to reverse-engineer, decompile, or extract proprietary components (if any)

5. AI-Generated Content

Whichi facilitates AI code generation via third-party providers (OpenAI, Anthropic, Google, etc.). You are solely responsible for:

• Reviewing and testing all AI-generated code before deployment
• Ensuring compliance with applicable licenses for generated code
• Any consequences arising from deploying AI-generated applications

We do not guarantee the accuracy, security, or fitness of AI-generated outputs.

6. Data & Privacy

Whichi is local-first. Your code and projects remain on your machine. We do not collect, store, or transmit your project data to our servers.

When using third-party AI providers (via BYOK), your prompts and code may be sent to those providers according to their respective privacy policies. Review each provider's terms before use.

Optional telemetry (opt-in only) may collect anonymous usage statistics to improve the Software. See our Privacy Policy for details.

7. Refunds & Cancellations

LTD licenses: Lifetime licenses are one-time purchases that grant ongoing software access according to the seats and provider access defined by the tier. Since LTDs are not subscriptions, cancellation is not applicable.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or secure.

9. Limitation of Liability

IN NO EVENT SHALL WHICHI, ITS CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the new Terms. Check this page periodically for updates.
